In a follow up to Homeland Security seizing the Bodog.com domain name, a federal grand jury in Baltimore, MD., has now indicted Bodog Entertainment Group, four Canadians involved with said group and Bodog founder Calvin Ayre. The indictments cover two charges stemming from June 2006 to January 2012, conducting an Illegal gambling business and money laundering conspiracy. Federal prosecutors allege that the group conspired to pay over $100 Million in sports gambling winnings through processors located in the United States. Calvin Ayre posted this statement through his blog; I see this as abuse of the US criminal justice system for the commercial gain of large US corporations. Iowa Senator Jeff Danielson is preparing a bill that would regulate online poker in Iowa. The legislation comes on the heels of the Department of Justice announcing that they have reversed their long-standing opinion that all forms of online gambling are illegal under the 1961 Wire Act.That admission by the DoJ, however, comes only after the same department handed down indictments last April against three online poker sites. Executives from PokerStars, Full Tilt Poker, and Absolute Poker were indicted on charges of fraud, with the government claiming the individuals disguised online gambling transactions to allow for processing.The Unlawful Internet gambling Enforcement Act of 2006 makes it illegal for financial institutions to process online gambling transactions. In the cases of the three poker sites, the government contends that it was the sites, not the banks, who were at fault for these transactions. When the indictment was handed down last year, millions of Americans were left without a safe place to play poker online.In addition, the players were not refunded the money they had in their accounts at Full Tilt Poker. There has recently been a change of opinion from the United States Department of Justice. The issue in question is how the Wire Act of 1961 affects various forms of online gambling. The Department of Justice has explained that its legal counsel has looked more carefully at the Wire Act, and is of the opinion that the act is not about all forms of online gambling, and only about sports gambling. Up until now, the federal authorities in the United States used the Wire Act to prohibit all forms of online gambling. The Wire Act was not used in isolation since the UIGEA (Unlawful Internet Gambling Enforcement Act) has effectively rendered online gambling illegal in the United States since it bans all online gambling transactions. However, many of the prohibitions to do with online gambling in the US have recently been connected to the Wire Act. The statement from the United States Department of Justice included the following: The Department of Justices view is and has been for some time that all forms of Internet gambling, including sports wagering, casino games and card games, are illegal under federal law. While many of the federal statutes do not use the term Internet gambling, we believe that the statutory language is sufficient to cover it. The statement further noted: The Criminal Divisions premise is incorrect and that the Wire Act prohibits only the transmission of communications related to bets or wagers on sporting events or contests.” While this will affect how online gambling is looked at in a legal sense, there are other issues that need to be addressed. For example, the American Gaming Association is still of the opinion that online gambling needs to be regulated and legalized on a federal level.
